Access to all pages of this public EVEREST Project Website, hereinafter the EVEREST Website, and the information relating to any of the services contained therein, implies acceptance of the conditions set out in this legal notice.

We therefore recommend that you, hereinafter the user, read this notice carefully.

1. Effective date for these conditions
These conditions are effective from the date that they have been added to the EVEREST Website. The project partners reserve the right to modify or delete, either wholly or partially, the current content of the website as they see fit. In the case that any modification is made to these conditions, the modification shall take effect on its respective date of publication and shall apply to all users of this website from that date forward.

2. Privacy and data protection policy
In the case that the user is asked to submit his/her personal data, he/she will be provided with the following information: the recipient of the data, the purpose of the request for this data, the identity and address of the person responsible for the data. He/she will also have the right to access, change or block the use of said personal data as it is being processed. The personal data collected will only be processed and/or released for the stated purpose and only with the user’s consent.

Exact procedures and rights are as follows:

2.1. Who is responsible for the processing of your personal data?

2.1.1. Your personal data are processed by EVEREST Project – the European Union’s Horizon 2020 project. You can contact us via e-mail at everest-info@a.alari.ch.

2.2. What categories of personal data do we process?

2.2.1. If you fill out the contact form on the EVEREST Website, or contact us via email, telephone, fax or social media channels, then we collect:

  • the basic identity information you provide us with, such as name, email address, postal address, telephone number, the company you work for, your function;
  • the content of your communication and the technical details of the communication itself (with whom you correspond at our end, date and time, etc.);
  • your preferences regarding receiving our email communications, such as newsletters, advertisements, etc.;
  • electronic identification data, such as IP address, and publicly available information of your profile on social media channels and any other personal data you choose to provide to us.

2.2.2. Whenever you leave us your business card or interact with us at fairs and events at which we are present, we may collect:

  • the basic identity information you provide us with, such as name, email address, postal address, telephone number, the company you work for, your function (i.e. when such information is provided by you or shown on your business card);
  • your image.

2.3 For what purpose do we use your personal data?

2.3.1. EVEREST Project processes your personal data to provide you and communicate with you in a personalized and efficient way with the information, products and/or services you request via the EVEREST Website, email, telephone, fax, social media channels and fairs and events. EVEREST Project may transfer your personal data to a third party for purpose of storing your personal data.

2.3.2. EVEREST Project processes your personal data to perform statistical analyses so that we may improve the EVEREST Website, our products and services or develop new products and services.

2.3.3. EVEREST Project processes your personal data to comply with legal obligations or to comply with any reasonable request from competent law enforcement agents or representatives, judicial authorities, governmental agencies or bodies, including competent data protection authorities. Your personal data may be transferred upon request to the police or the judicial authorities as evidence or if there are justified suspicions of an unlawful act or crime committed by you through your registration with or use of the EVEREST Website, our social media channels or other communication with us.

2.3.4. EVEREST Project may process your personal data for the preservation of the legitimate interests of the EVEREST Project, its partners or a third party if and when your registration with, or use of, the EVEREST Website, social media channels or other communication channels can be considered (a) a violation of any applicable terms of use or the intellectual property rights or any other right of a third party, (b) a threat to the security or integrity of the EVEREST Website, (c) a danger to the EVEREST Website or any of EVEREST Project’s or its subcontractors’ underlying systems due to viruses, Trojan horses, spyware, malware or any other form of malicious code, or (d) in any way hateful, obscene, discriminating, racist, slanderous, spiteful, hurtful or in some other way inappropriate or illegal.

2.3.5. EVEREST Project processes your personal data mentioned under clauses 2.2.1, 2.2.2 above for marketing purposes, i.e. to provide you with targeted communications, promotions, offerings and other advertisements of the EVEREST Project and its partners. EVEREST Project will only send you communications, promotions, offerings, newsletters  (newsletters are deemed as an advertisement) and other advertisements via email or other person-to-person electronic communications channels if you have explicitly consented to receiving such communications, newsletters and other advertisements.

2.4. Why is our processing of your personal data legitimate?

2.4.1. For the processing of your personal data for the purpose outlined in clause 2.3.1, 2.3.2 and 2.3.5, we ask for your consent.

2.4.2. The processing of your personal data for the purpose outlined in clause 2.3.3 and 2.3.4 is necessary to allow EVEREST Project to comply with its legal obligations and for securing EVEREST Project’s legitimate interests, which are:

allowing us to defend ourselves in legal proceedings;
keeping the EVEREST Website, social media channels, products and services safe from misuse and illegal activity;
safeguarding our commercial and business interests and needs in light of changing market conditions;
marketing and promotion of our products, services, brands an overall successful commercialization of our products and services.

2.4.3. For processing your personal data for the purposes outlined in clause 2.3.1, EVEREST Project as the responsible party asks for your consent. By consenting to our processing of your personal data for sending you communications, promotions, offerings, newsletters and other advertisements via email or other person-to-person electronic communications channels, you agree that we are allowed to process your personal data for this purpose in the manner and under the conditions outlined in this Privacy and data protection policy.

2.5. What are our quality assurances?

2.5.1. EVEREST Project does its utmost to process only those personal data that are necessary to achieve the purposes listed under the purpose for processing.

2.5.2. Your personal data is processed only for as long as necessary for the purposes listed above or up until such time where you withdraw your consent for processing them. EVEREST Project will de-identify your personal data when they are no longer necessary for the purposes outlined in the purpose for processing, unless there is:

an overriding legitimate interest of the EVEREST Project or any other third party in keeping your personal data identifiable;
a legal or regulatory obligation or a judicial or administrative order that prevents the EVEREST Project from de-identifying them.

2.5.3. EVEREST Project will take the appropriate technical and organizational measures to keep your personal data safe from unauthorized access or theft as well as accidental loss, tampering or destruction. Access by personnel of the EVEREST Project or its third party processors will only be on a need-to-know basis and subject to strict confidentiality obligations. You understand, however, that safety and security are best efforts obligations only, which can never be guaranteed.

2.6. What are your rights?

2.6.1. You have the right to request access to all personal data processed by the EVEREST Project in relation with you. EVEREST Project reserves the right to charge an administrative fee for multiple subsequent requests for access that are clearly submitted for causing nuisance or harm to the EVEREST Project.

2.6.2. You have the right to ask that any personal data in relation with you that are inaccurate, are corrected free of charge.

2.6.3. You have the right to withdraw your earlier given consent under clause 2.4.3 for processing your personal data.

2.6.4. You have the right to request that personal data in relation with you will be deleted if they are no longer required according to the purposes which are outlined above or if you withdraw your consent for processing them. However, you need to keep in mind that a request for deletion will be evaluated by the EVEREST Project against:

overriding legitimate interests of the EVEREST Project or any other third party;
legal or regulatory obligations or administrative or judicial orders which may contradict such deletion.

2.6.5. You have the right to oppose the processing of personal data if you are able to prove that there are serious and justified reasons connected with his particular circumstances that warrant such opposition. However, if the intended processing qualifies as direct marketing, you have the right to oppose such processing free of charge and without justification.

2.6.6. You have the right to receive from us in a structured, commonly used and machine-readable format all personal data you have provided to us.

2.6.7. If you wish to submit a request to exercise one or more of the rights listed above, you can send an email to everest-info@a.alari.ch for all data subject rights matters. An email requesting to exercise a right shall not be construed as consent with the processing of your personal data beyond what is required for handling your request. Such request should clearly state and specify which right you wish to exercise and the reasons for it if such is required. It should also be dated and signed, and accompanied by a digitally scanned copy of your valid identity card proving your identity.

2.6.8. EVEREST Project will promptly inform you of having received such request. If the request proves valid, EVEREST Project shall notify you as soon as reasonably possible and at the latest thirty (30) days after having received the request.

2.6.9. If you have any complaint regarding the processing of your personal data by the EVEREST Project, you may always contact the EVEREST Project via the email address mentioned in the first paragraph of this clause. If you remain unsatisfied with the EVEREST Project’s response, you are free to file a complaint with the competent data protection authority accordingly to the state legislation of the processor of your personal data.

3. Intellectual and industrial property

The EVEREST Website, as well as all pages comprising it and the content contained therein may include documents, photographs, drawings, graphics, databases, computer programs, logotypes, trademarks, brand names and other distinctive signs protected by intellectual or industrial property rights of which the project partners are the owner or for which they hold the legitimate license.

The project partners make no warranty as to the legitimacy or legality of the content contained in the EVEREST Website when it is not owned by the project partners.

4. Permitted and prohibited usage

The user may view, print, copy or store the content of the EVEREST Website on the hard drive of his/her personal computer or on any other physical media provided that it is solely and exclusively for his/her personal and private use.

Commercial use of these contents including but not limited to the reproduction, distribution, transfer to third parties, public communication or transformation, on or over any channel or medium is expressly prohibited without the prior authorization of the respective owners and may constitute an offense punishable by law.

It is the sole responsibility of the user to use, save and store the content and services appropriately as well as to ensure that he/she does not infringe upon any of the intellectual or industrial property rights of the EVEREST Partners.

Under no circumstances does this notice constitute an authorization or licensing of property rights.
